Introduction
The Plexus Motor Prosecution (MPS) Team specialises in representing those investigated or prosecuted for any motoring offence. The team are able to advise from the outset, providing a single point of contact and representation throughout. Geographically there are no constraints, with the team able to deal with matters anywhere in the country.
Once a matter has been notified to us we are able to visit the client and seek immediate instructions as to how the event occured. We visit the scene of the accident and prepare an advice to insurers and policyholders alike outlining the possible actions that may follow.
In cases where an interview under caution is requested we are able to explain the process to the policyholder and request disclosure. At this stage, advise is provided as to whether we should proceed with a no comment, prepared statement or full account in the interview.
The team will personally appear in court on the policyholders behalf. They deal with all hearings such as entering a plea, pre-trial review/plea and case management hearing and the substantive trial. In the event of a guilty plea we are able to mitigate advancing special reasons and exceptional circumstances arguments.
In most cases we personally appear in court to represent policyholders, not only to safeguard their interests but also to test evidence, which may form the basis of a civil claim. We also, provide a watching brief at these hearings and report back to insurers with detailed information as to accident circumstances and the witness/expert evidence.
Where we consider a decision has been made unreasonably by the Police, court or CPS the team have extensive experience in pursuing such matters to a Judicial Review in the High Court.
The knowledge and experience within the MPS team limits the need for outside expertise setting them apart from others and in turn helping to keep costs down.
